Welcome to FlightPal LLC ("FlightPal," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (including www.tryflightpal.com), our mobile application(s), and any related services, content, and tools (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (which is incorporated herein by reference). If you do not agree with these Terms or the Privacy Policy, you must not use the Service.
We may update or modify these Terms from time to time. We will post the revised Terms with a new "Last Updated" date. We may also provide additional notice (e.g. via email or in-app notification) of significant changes. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to any update, you should stop using the Service.
FlightPal is a digital platform designed to help users manage and overcome flight-related anxiety through educational and supportive tools. Depending on your usage, the Service may include, but is not limited to:
All information, content, and tools provided by FlightPal (including responses from the AI Coach and materials from any VR or partner integrations) are for informational and self-help purposes only. They are not intended to diagnose, treat, cure, or prevent any medical or psychological condition, nor should they be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a physician, licensed therapist, or other qualified health provider with any questions you may have regarding a medical or mental health condition. Never disregard professional medical advice or delay seeking it because of something you have read or accessed through the Service.
The Service (including any VR components or apps) is not a medical device and has not been reviewed or approved by the FDA or any other medical regulatory authority. FlightPal does not guarantee any particular outcome or result from using the Service. Individual results in anxiety reduction or comfort with flying will vary.
If you have a severe fear of flying that significantly impairs your ability to function, or if you suspect you have an anxiety disorder or other mental health condition, you should consult a qualified healthcare professional. Use of our Service does not create a doctor–patient or therapist–client relationship between you and FlightPal or any of its personnel, even if the content is created or reviewed by licensed professionals. Always use your own best judgment and, when in doubt, seek in-person professional help.
Certain features of FlightPal may require you to create a user account. When you register or use the Service, you agree to the following:
You may need to create an account by providing information such as your name, email address, and a password (or by using a supported third-party login like Google). You agree to provide truthful, accurate, current, and complete information during registration and to update this information promptly if it changes. You are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your account.
You agree to notify us immediately at info@flightpal.com if you suspect any unauthorized access to or use of your account. FlightPal is not liable for any loss or damage arising from your failure to adequately safeguard your account credentials. You are responsible for all activities that occur under your account (except those due to FlightPal's own breach of these Terms or negligence).
By creating an account or using the Service, you represent and warrant that you meet the minimum age requirement stated in Section 1 (Acceptance). If you are under 18 (or the age of legal majority where you live), you must use the Service under the supervision of a parent or legal guardian who consents to these Terms. If you are a parent or guardian of a minor who uses our Service, you are fully responsible for that minor's use and compliance with these Terms.
The Service is intended for personal use by individuals who wish to address their own flight anxiety or support someone (like a dependent) with flight anxiety. It is not intended for use by organizations to provide services to others, except as separately agreed in writing with FlightPal.
We reserve the right to suspend, deactivate, or terminate your account or your access to some or all of the Service at any time at our sole discretion, especially if we believe you have violated these Terms or engaged in behavior that is unlawful, abusive, or that disrupts the Service or other users. We may also remove or disable any content you have contributed if we determine it violates our policies (see Section 7 on User Conduct).
If your account is terminated or suspended, you remain bound by these Terms as applicable. We are not liable to you or any third-party for any termination of your account or access to our Service. If you wish to delete your account, you may do so by contacting us at info@flightpal.com or through any account deletion functionality we provide. Our handling of your personal data upon account deletion is described in our Privacy Policy.
Certain premium features or full access to the FlightPal program may require a paid subscription or one-time payment. The following terms apply to purchases made through the Service:
FlightPal may offer subscription plans (e.g., monthly or annual plans) or other paid products that grant you access to additional content and features beyond the free offerings. All pricing for subscriptions or purchases will be stated at the time of purchase. Prices are listed in U.S. dollars (unless otherwise specified) and may be subject to applicable taxes. We reserve the right to change the pricing of any Service or offer new pricing plans at our discretion; however, no price change will apply to you until your next billing cycle or a new purchase, and we will notify you in advance if a pricing change affects your existing subscription.
We may offer free trial periods for subscription services. If you sign up for a free trial, be aware that once the trial period expires, your account may automatically convert to a paid subscription and your provided payment method will be charged, unless you cancel before the trial ends. We will inform you of the length of any trial and the pricing that will apply after the trial. It is your responsibility to track the trial period and cancel in time if you do not wish to continue with a paid plan.
Subscriptions are generally set to auto-renew at the end of each billing period (e.g., monthly or yearly) to avoid interruption of service. This means your credit card or chosen payment method will be charged automatically at the then-current subscription rate, plus any applicable taxes, unless you cancel the subscription prior to the next renewal date. By subscribing, you authorize FlightPal (or our third-party payment processors) to charge your payment method on a recurring basis.
Payments for the Service (including subscription fees) are handled by third-party payment processors (for example, Stripe, PayPal, the Apple App Store, Google Play, or other platforms depending on where you make the purchase). FlightPal does not directly collect or store your full credit card number or banking information for these purchases; such information is provided by you to the third-party processor pursuant to their terms of service and privacy policy. By providing a payment method, you represent that you are authorized to use that payment method and you authorize the processor to charge the full amount due for the subscription or purchase.
If your payment method fails or if your account becomes past due, we may suspend or revoke access to paid features until you resolve the issue. It is your responsibility to ensure that all payment information is accurate and up to date. FlightPal is not responsible for any fees or charges (e.g., overdraft fees, foreign exchange fees) that you may incur when billing occurs.
Cancellation: You may cancel your subscription at any time. If you subscribed via our website, you can cancel by logging into your FlightPal account settings (if available) or by contacting our support at info@flightpal.com. If you subscribed via a mobile app store (e.g., Apple App Store or Google Play Store), you must manage and cancel your subscription through that platform's subscription management settings; FlightPal cannot cancel or modify subscriptions on your behalf for purchases made through third-party app stores.
Effect of Cancellation: When you cancel a subscription, the cancellation will take effect at the end of the current billing period. You will retain access to the paid features until that period ends, and your subscription will not renew thereafter. We do not typically provide pro-rated refunds for mid-period cancellations, except where required by law or explicitly stated otherwise.
General No-Refund Policy: Fees (including subscription fees) are generally non-refundable once charged. For example, if you cancel after your subscription has renewed for a new term, that term will remain active until its end date but you will not receive a refund for the remaining period, except in jurisdictions that require a refund by law. We reserve the right to consider special refund requests on a case-by-case basis in our sole discretion, but we are not obligated to provide a refund in cases such as forgetting to cancel before renewal, not using the Service after purchase, or dissatisfaction except as required by consumer protection laws.
App Store Purchases: If you purchased through the Apple App Store or Google Play, the app store's refund policies will apply. We do not have the ability to process refunds for purchases made through third-party platforms. You will need to contact the app store support for any refund requests or billing disputes for those purchases.
Nothing in these Terms affects any rights you may have under applicable consumer law, including your ability to withdraw from online purchases in certain cases or receive remedies for faulty digital content as required by law.
FlightPal reserves the right to modify or discontinue, temporarily or permanently, any part of the Service (including subscription offerings and pricing) with or without notice. If we make material changes to a subscription service you have paid for, we will endeavor to notify you. If any such change negatively affects your use of the Service or pricing, and you do not agree to the change, your sole remedy will be to cancel your subscription. Continued use of the Service after a change indicates your acceptance of the new terms or pricing.
Using FlightPal involves engaging with content and exercises intended to reduce anxiety. It's important that you do so safely and with realistic expectations:

FlightPal includes an AI-powered virtual coach (such as the "Flighty" chat assistant) and may integrate other third-party tools or content. The following terms apply to those features:
By using the AI coach and other tools, you acknowledge these limitations and agree that you will not use these features in violation of any law or in ways that could result in harm to you or others. If you have any concerns about the AI or integrated tools, contact us for support or simply refrain from using those features.
We strive to maintain FlightPal as a safe, positive, and respectful environment. Whether you are interacting with the AI, accessing content, or communicating with other users in a community setting, you agree to abide by the following rules of conduct:
We reserve the right (but are not obligated) to monitor user interactions and content on the Service. If you violate any of the above rules or otherwise behave in a way that we deem inappropriate or unsafe, we may take action. Such action can include removing or editing content you posted, issuing you a warning, suspending your community privileges, or banning/terminating your account. These actions are at our sole discretion, and our failure to act immediately on a violation does not waive our right to enforce the rules later.
If you witness behavior that violates these rules or have concerns about any content on FlightPal, please notify us by emailing info@flightpal.com. While we can't guarantee to review everything immediately, we will make good faith efforts to address reported issues.
When community or social features are available, users may post, submit, or share content such as text (posts, comments), images, or other materials ("User Content"). This section explains your rights and responsibilities regarding User Content:
You retain any ownership rights you have in the User Content you create and share on FlightPal. FlightPal does not claim ownership over the text, images, or other materials that you post to the Service. You are the owner of your own content.
However, by submitting or posting User Content through our Service, you give FlightPal certain permissions to use that content as described below.
Permission to Use Your Content: By posting or otherwise sharing User Content on or through the Service, you hereby grant FlightPal a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to use, host, store, reproduce, distribute, modify (for example, reformat or translate), display, and perform your User Content, and create derivative works of your User Content solely for the purposes of operating, developing, providing, and improving the Service, and for promoting the Service.
In simpler terms, this license allows us to display your posts to other users, adapt them to different formats (e.g., showing them on mobile vs. web), and include them in things like community highlight reels or marketing materials that showcase user experiences. We will never sell your personal content to others without your permission, and this license does not grant us the right to use your content outside of FlightPal's services except in connection with promoting FlightPal.
You are solely responsible for the User Content you post. This means:
FlightPal is not obligated to actively monitor User Content, but we reserve the right to do so. Our team or automated systems may monitor discussions and posts in order to maintain a respectful and safe environment, or to troubleshoot or improve the Service. We reserve the right to edit or remove any User Content, in whole or in part, that violates these Terms or for any other reasonable reason. However, the author of content remains solely responsible for it. FlightPal is not responsible for any failure or delay in removing any inappropriate content.
If you choose to provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you agree that FlightPal is free to use and incorporate such Feedback in our products or services, without any obligation to you. You hereby grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate any Feedback you provide in any manner we choose. This helps us improve our product—thank you for helping us fly higher!
FlightPal respects intellectual property rights and expects users to do the same. This section outlines the ownership of the FlightPal content and our respective rights:
All materials and content provided as part of the Service—including text, graphics, logos, button icons, images, audio clips, videos, software (including the app and website code), algorithms, design elements, interactive features, and the arrangement of these elements—are the property of FlightPal or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws. This includes the overall "look and feel" of the Service, the FlightPal program curriculum, and any content created by our team or contributors.
Limited License: Subject to your compliance with these Terms, FlightPal grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service and FlightPal Content for your personal, non-commercial purposes only. This means you may use our app and website, view content, and utilize our tools for your own personal benefit in overcoming flight anxiety. No other use is permitted.
Without limiting the generality of the above, you agree not to:

In short, while FlightPal may connect you with useful external resources to enrich your journey, any time you leave our controlled environment or engage with a third party, you should understand that FlightPal is not in charge of that experience. Exercise good judgment and caution when interacting with Third-Party Services.
FlightPal provides the Service "AS IS" and "AS AVAILABLE" to the maximum extent permitted by law. While we aim to provide a great experience, we cannot guarantee that our Service will be perfect or that it will meet all of your expectations.
Summary: We want FlightPal to be helpful, but we cannot promise it will be flawless or effective for you. We are providing this service in good faith and with reasonable skill, but without any express or implied warranties. If you're not sure whether FlightPal is appropriate for you, you should seek professional advice.
If you are dissatisfied with the Service or any portion of it, your sole and exclusive remedy is to discontinue use of the Service.
To the extent permitted by law, in no event will FlightPal or its parent company, affiliates, officers, employees, agents, partners, or licensors (the "FlightPal Parties") be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of (or inability to use) the Service, or these Terms. This includes, without limitation, any damages for lost profits, lost data, personal injury, emotional distress, pain and suffering, or the cost of obtaining substitute services – even if we have been advised of the possibility of such damages.
Specific examples of what FlightPal is not liable for include (but are not limited to):
To the fullest extent permitted by applicable law, the total liability of the FlightPal Parties for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to FlightPal, if any, in the 12 months immediately preceding the event giving rise to such claim, or one hundred U.S. dollars (US $100), whichever is greater. If you have not paid anything to FlightPal (for example, if you only used the free features), FlightPal's total liability to you for any damages will be capped at $100.
This limitation applies cumulatively to all claims, and all claims and causes of action must be brought within one year of accrual or be permanently barred (to the extent such limitation is allowed by law).
Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those jurisdictions, FlightPal's liability will be limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless FlightPal and its affiliates, officers, directors, employees, agents, partners, and licensors (the "Indemnified Parties") from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) that arise out of or are related to:
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim). You agree not to settle any such matter without the prior written consent of FlightPal. We will make reasonable efforts to inform you of any such claim, action or proceeding upon becoming aware of it.
This indemnification obligation will continue after you stop using the Service or after termination of these Terms.
Most concerns or questions can be resolved by contacting our support team at info@flightpal.com. You agree to try to resolve any dispute informally by contacting us first. We will attempt to resolve the dispute informally by contacting you via email or other means. If a dispute is not resolved within 30 days of submission, you or FlightPal may proceed as outlined below.
If we cannot resolve a dispute informally, you and FlightPal agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief as set forth below) arising out of or in connection with or relating to these Terms or your use of the Service (each, a "Dispute") by binding arbitration on an individual basis. This includes any claims relating to the validity, applicability, or interpretation of this arbitration clause, and any claims against our affiliates, subsidiaries, or other related entities.
Arbitration means that the Dispute will be resolved by a neutral arbitrator instead of in a court by a judge or jury. You and FlightPal expressly waive the right to a trial by jury or to participate in a class action for any Dispute, as explained below.
You and FlightPal agree that any arbitration (or, if arbitration is not enforced, any court proceeding) will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and FlightPal each waive any right to a jury trial and the ability to participate in a class action or similar collective proceeding.
No Class Arbitration: The arbitrator shall not consolidate the claims of multiple parties and shall not otherwise preside over any form of a representative or class proceeding. The arbitrator can decide only your and/or FlightPal's individual Dispute. The arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
Arbitration shall be initiated through the American Arbitration Association ("AAA") or another established alternative dispute resolution provider (by mutual agreement of the parties) that offers arbitration as set forth in this section. If AAA is used, the arbitration shall be conducted under the Consumer Arbitration Rules then in effect for the AAA, except as modified by these Terms. The AAA rules are available at www.adr.org or by calling AAA at 1-800-778-7879.
Notwithstanding the above, both you and FlightPal retain the right to:
Opt-Out: You have the right to opt out of the binding arbitration and class action waiver provisions in this Section by sending a written notice of your decision to opt out to the following email: legal@flightpal.com, with the subject line "Arbitration Opt-Out." Your opt-out notice must be sent within 30 days of your first use of the Service or, if you are already a user, within 30 days of the effective date of the first Terms containing an arbitration agreement. Otherwise, you will be bound to arbitrate disputes in accordance with these Terms. If you opt out of these arbitration provisions, FlightPal also will not be bound by them.
These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with the laws of the State of Delaware, USA, without giving effect to its conflict of law principles, except to the extent that U.S. federal law (including the Federal Arbitration Act) applies. If you are using the Service outside of the United States, you understand and agree that U.S. law shall apply to the maximum extent permissible.
Subject to the arbitration provisions above, if any matter arises that for some reason is not subject to arbitration or enforcement of the arbitration award is required, you and FlightPal agree that any judicial proceedings (other than small claims actions) will be brought in and adjudicated solely in the state or federal courts located in New Castle County, Delaware, USA. Both you and FlightPal consent to venue and personal jurisdiction in those courts and waive any objections or defenses thereto.
FlightPal is based in the United States, and our infrastructure is primarily located there. We make no representation that the Service is appropriate or available for use in locations outside the U.S., or that the Terms comply with the laws of any other country. Users who access the Service from outside the U.S. do so at their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
You may not assign or transfer these Terms (or any rights or obligations in these Terms) without our prior written consent. Any attempted assignment by you in violation of this section is void. FlightPal may freely assign or transfer these Terms (in whole or in part) to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets, or by operation of law or otherwise.
These Terms (together with the Privacy Policy and any other legal notices or guidelines posted on our website or mobile app) constitute the entire agreement between you and FlightPal regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
